本律师最近收到多宗“学生创业移民”的投诉和咨询，大部分牵涉留学生在南澳州买生意惨淡经营，在未经营够18个月的时候，已经亏本。其中一个学生每个月亏本一万二千元。

根据本律师的初步调查，在南澳州所流传的“学生创业移民”是没有这个签证类别的。而他们都是以“845签证”的条件申请移民。依据移民局845类别的条件，大致内容如下：

1.申请人有暂时居留的签证，而该签证不可少于18个月。

2.该人士必须在澳洲经营生意。

3.该人士在申请前12个月必须拥有固定净值资产超过澳币25万元。

4.在申请签证的时候，该人士必须在申请该签证12个月前，经营及成立生意不少于18个月，而该生意的净值资产不可以少于澳币10万元。

5.在过往的12个月内，该人士必须积极参与以及每天直接负责该生意的经营运作及管理 “actively involved in, and directly responsible for,the day-to-day management and overall performance of the main business”。

6.在未经营该生意之前，必须有过往的成功经营生意的纪录"have had a overall successful business career"。

7. 必须聘请三个澳洲公民或居民为全职雇员。

8.该生意每年的营业额不少于$25万澳元，出口商业的话不可以少于$10万澳元。

9.及必须拿有Business Skill Point Test 105分。

整体来说，除非有特殊条件，否则学生是不符合845签证的。最近两个月每星期接到多宗的投诉和咨询，有关生意惨淡经营失败的情况，不能退租而招致巨大的经济责任和损失。希望各位学生留意，845签证是有明文规定的。该生意必须经营18个月以上，并必须聘请三个澳洲公民或居民为全职雇员。申请过程最少五个月以上。再者在南澳州经营生意不是一件容易的事，希望各位学生谨慎处理，不要以为买一档生意便可以够条件申请845签证，否则会付出沉重的代价。
